Welcome to Coastal Marsh Adventures! By booking a tour or using our website, you agree to the following terms and conditions. Please read them carefully.
1. Booking and Payment
1.1 Reservations: All reservations must be made through our website or by contacting our office directly. 1.2 Payment: Full payment is required at the time of booking. We accept major credit cards and other payment methods as indicated on our website. 1.3 Confirmation: Upon successful payment, you will receive a booking confirmation via email. Please check the details carefully and inform us of any discrepancies immediately.
2. Cancellations and Refunds
2.1 Cancellation by You: Cancellations must be made at least 48 hours prior to the scheduled tour for a full refund. Cancellations made within 48 hours of the tour will not be refunded. 2.2 Cancellation by Us: Coastal Marsh Adventures reserves the right to cancel tours due to unforeseen circumstances, including but not limited to inclement weather or safety concerns. In such cases, a full refund or rescheduling option will be provided. 2.3 No Shows: Failure to appear for your tour will result in forfeiture of the full amount paid.
3. Safety and Conduct
3.1 Safety: Safety is our top priority. Participants must follow all safety instructions provided by our guides. Failure to comply may result in termination of the tour without refund. 3.2 Conduct: Participants are expected to behave respectfully towards other guests, staff, and the natural environment. Any behavior deemed disruptive or harmful will result in immediate removal from the tour without refund.
4. Liability and Waiver
4.1 Assumption of Risk: Participation in our tours involves certain inherent risks. By booking a tour, you acknowledge and accept these risks. 4.2 Liability Waiver: Coastal Marsh Adventures, its employees, and affiliates are not liable for any injury, loss, or damage to person or property arising from participation in our tours. 4.3 Indemnity: You agree to indemnify and hold harmless Coastal Marsh Adventures from any claims, damages, losses, liabilities, and expenses arising out of your participation in our tours.
5. Health and Fitness
5.1 Health Conditions: Participants must be in good health and reasonably fit to participate in our tours. Any health conditions that may affect participation must be disclosed at the time of booking. 5.2 Medical Assistance: In case of a medical emergency, you consent to receive necessary medical treatment. All costs associated with medical treatment are the responsibility of the participant.
6. Privacy
6.1 Personal Information: We are committed to protecting your privacy. Personal information collected during the booking process will be used solely for the purpose of providing our services and will not be shared with third parties without your consent. 6.2 Data Security: We implement reasonable security measures to protect your personal information from unauthorized access, disclosure, or misuse.
7. Photography and Media
7.1 Photography: Coastal Marsh Adventures may take photographs and videos during tours for promotional purposes. By participating, you consent to the use of your image in such media. 7.2 Opt-Out: If you prefer not to be photographed or filmed, please inform your guide at the beginning of the tour.
8. Changes to Terms and Conditions
8.1 Amendments: Coastal Marsh Adventures reserves the right to update or modify these terms and conditions at any time without prior notice. Changes will be posted on our website, and continued use of our services constitutes acceptance of the updated terms.
9. Governing Law
9.1 Jurisdiction: These terms and conditions are governed by the laws of the state in which Coastal Marsh Adventures operates. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in that state.
